International Convention for the Protection of New Varieties of Plants. The Convention was adopted in Paris in 1961 and revised in 1972, 1978 and 1991. It established the International Union for the Protection of New Varieties of Plants (UPOV) aims to protect new varieties of plants by an intellectual property right.

Regulation of the People`s Republic of China on Protection of New Varieties of Plants

Promulgated by the State Council on 20 March 1997 and effective as of 1 October 1997, with 46 articles stipulating the protection of new varieties of plants, and mainly contains the general provisions, content and ownership of rights, conditions for granting rights, application and receipt.

Promulgated by Ministry of Forestry on 10 August 1999 and effective as of the same day, with 70 articles stipulating the protection of new varieties of plants (forest part), and mainly contains the general provisions, content and ownership of rights, conditions for granting rights and application.

Tentative Provisions on Applications by Applicants of Taiwan for the Rights of New Plant Varieties in the Mainland

Released by the Ministry of Agriculture and State Forestry Administration on 22 November 2010, this regulation applies to applications from Taiwan to the mainland authorities in charge of approving new varieties of plants, including the application documents, claiming priority, novelty, application procedures etc.
