Tort Law of the People's Republic of China

The Tort Law of the People’s Republic of China, which was adopted by the Standing Committee of the Eleventh National People’s Congress on 26 December 2009, and came into force on 1 July 2010, is a basic law of tort liability in China. It provides terms of general provisions, constituting liability and method of assuming liability, circumstances to waive and mitigate liability, special provision on tortfeasors and seven special tort liabilities.

People’s Mediation Law of the People’s Republic of China

Approved by National People's Congress Standing Committee on 28 August 2010, the Mediation Law is the basic law on the people's mediation system which provides the principles of people's mediation, mediation committees, people's mediators, the mediation process and mediation agreements etc.

Legislation adopted by NPC on April 12, 1986, promulgated on 12 April 1986 and effective as of 1 January 1987 with 165 articles on the basic legislation of the Chinese civil law system, defining IPR as civil rights (general provisions and principles therein applicable to IPR).

Judicial interpretation adopted at the 528th meeting of the Judicial Committee of the Supreme People’s Court and promulgated by Judicial Interpretation No.22 [1922] of the Supreme People’s Court on 14 July 1992, with 320 articles supplementing the Civil Procedure Law.

Legislation adopted at the Ninth Meeting of the Standing Committee of the Eighth National People’s Congress on August 31, 1994, promulgated by Order No.31 of the President on August 31, 1994 and effective as of September 1, 1995, with 80 articles governing arbitration.

Contract Law

Legislation adopted at the 2nd Session of the 9th National People’s Congress, promulgated by Order No. 15 of the President on 15 March 1999 and effective as of 1 October 1999, with 428 articles governing all kinds of contracts. Relevant provisions therein are applicable to IP related contracts.

Judicial interpretation adopted at the 1375th meeting of the Judicial Committee of the Supreme People’s Court on 26 December 2005, promulgated by the Supreme People’s Court on 23 August 2006 and effective as of 8 September 2006, with 31 articles further specifying the Arbitration Law.
