EU-China workshop and seminar on IPR and technology transfer, 12-14 October 2010, Shanghai and Ningbo |

Together with the Ministry of Science and Technology of China (MOST) and the Shanghai Technology and Trade Exchange (STTE), IPR2 will organise a workshop and seminar on IP issues and technology transfer. Technology transfer is an important issue in the implementation of China’s National IP Strategy to reinforce technological innovation and transform innovation results to productivity. An efficient and well functioning IP system is one of the prerequisites needed by industry to innovate, and in building promoting respect for innovation and IP rights. Given that the IP system is complex and continuously evolving in interaction with other domestic and international rules and regulations and needing to be adapted to changing conditions, these types of collaborative exchanges, comparative analysis and dialogue between European and Chinese officials, industry and researchers are particularly important in developing appropriate policy responses. As a part of this work, later this month IPR2 will support a study tour for a delegation of MOST officials as part of developing a sustained platform of exchanges with European counterparts on IP and technology related issues. MOST is responsible for regulation and development of the postal service, Internet, wireless, broadcasting, communications, production of electronic and information goods, software industry and the promotion of the national knowledge economy.

EU-China study tour on innovation and technology transfer, 25 October-2 November 2010, United Kingdom and France |

IPR2 will support a study tour for a delegation of officials from the Ministry of Science and Technology (MOST) as part of developing a sustained platform of exchanges with European counterparts on IP and technology related issues.
Technology transfer is an important issue in the implementation of China’s National IP Strategy to reinforce technological innovation and transform innovation results to productivity. An efficient and well functioning IP system is one of the prerequisites needed by industry to innovate, and in building promoting respect to innovation and IP rights. The IP system is a complex system which evolves in continuous interaction with many other domestic and international rules and regulations and requires constant evolution and adaptation to changing conditions. This study tour is part of broader co-operation which aims to explore whether the current IP system is fitting in helping to address current challenges. The study tour will be led by the Department of High Technology of MOST and will further support such exchanges on policy setting and, in particular, on the implementation and facilitation of such policies. The officials will meet with European government agencies to further explore European experiences in drafting policies supporting the development of a strong IP system to encourage innovation and transfer of knowledge and technologies, and encouraging mechanisms for the financing of innovation. In addition, the study tour will look at innovation and service agencies’ mechanisms and channels for policy implementation including: - governing the ownership, exploitation, sharing of revenues, licensing of IPR resulted from publicly-funded research, with the aim of promoting technology transfer to industry and spinout creation
- management of IPR portfolios by public research offices, and in academic projects (e.g. Invention disclosure process, identification of potential licensees)
- networks for dissemination of research results and technologies; channels of knowledge transfer (patenting, licensing, training, spinouts, collaborative research); establishment of KTOs (knowledge transfer offices) and TTOs (TT offices) in Europe
- model agreements (such as the Lambert agreements in the UK)
- experiences of state agencies or institutions which provide expertise and advice on IP management to SMEs (e.g. ARIST in France)
- support of closer cooperation between universities and enterprises to ensure better dissemination of knowledge in the economy and wider society
- investment and financing service systems, etc.
This builds on the work of a study tour with MOST earlier in 2010 on the management of intellectual property in Science and Technology programmes, which aimed to inform Chinese decision-makers on the function and use of IPRs, towards a more transparent, predictable IP environment, and ultimately intensified legal use of IP. The openness of the exchanges lent support to further benefits on both sides from engaging in a continuing open exchange of experiences and practices. Read more. MOST is in the process of studying and drafting legal measures of IP management of government science and technology plans. In this context, MOST is seeking a detailed overview on how European counterparts address issues related to the practice of IP management within S&T plans, hence learn from EU best practices and experiences in this field. MOST seeks to use the content of this study mission as an important input and reference for the formulation of the above mentioned measures, but also comprehensively strengthen its IP management capabilities. EU-China support to IP protection at trade fairs in Europe, Berlin, 3-8 September 2010 |

IPR2 continues to work closely with the Ministry of Commerce (MOFCOM) to support the protection of intellectual property at trade fairs, with information and mediation support at Berlin’s annual IFA trade fair, the world’s largest for consumer electronics. The information and mediation service aims to address problems that have occurred at international trade fairs in the past – helping exhibitors with advice or interpretation and to address IP-related problems as they arise during the days of fair. This activity forms part of IPR2's ongoing collaboration with MOFCOM on the protection and enforcement of IP rights at trade fairs, specifically information and mediation support, and builds on the experience gained at the CeBIT trade fair in Hanover in March 2009 and 2010, the IFA exhibition in Berlin and Schweissen and Schneiden in Essen in September 2009, the preparation of a study on European experiences and practices and the EU-China Seminar on the Protection of IPR at Trade Fairs, in Beijing and Shenzhen in November 2007. IPR2 at World Expo 2010 Shanghai - Introducing the European Community Trademark System, Shanghai, 3 September 2010 |

IPR2 will be present at this year’s World Expo in Shanghai with activities dedicated to building awareness of the importance of IP protection and enforcement. Hosted in the EU-Belgian Pavilion which has thematic displays representing ‘Intelligent Europe’, this includes an introduction to European; Community Trademark (CTM) system and cooperation between the EU and China on trademark-related issues, including trademark registration and review processes and practices. The following day will address an issue of international relevance – how to protect and enforce intellectual property rights at trade fairs. Read more. On 3 December 3, 2002, at the 132nd General Assembly of the International Exhibitions Bureau, Shanghai won the bid on to host the World Expo 2010. The theme of the Expo 2010 is ‘Better City, Better Life’ representing the central concern of the international community for future policy making, strategies and sustainable development in the urban environment. Read more. SAIC is the ministerial authority in charge of market supervision/regulation and related law enforcement. The main areas of activity include trademark exclusive rights protection, fair competition maintenance, consumers' rights and interests' protection and enterprises' registration. SAIC operates directly under the State Council of the PRC. In the framework of IPR2, OHIM has co-operated with SAIC on a number of activities, including a comparative study of trademark registration practices and systems in China - as managed by SAIC - and the Community Trade Mark (CTM) system in Europe - as implemented by OHIM. The main goal of the comparative study was to identify areas for improvement of the performance and management of the administration and registration procedures relating to trademarks. Furthermore, IPR2 supported a study tour by SAIC officials to Spain, Luxembourg and Germany, to build knowledge on the European trademark system and support an exchange of expertise between Chinese and European officials and judges on emerging trademark registration and judicial review issues. Read more. In the same week, IPR2 together with SAIC, organised two one-day seminars in Madrid and Munich on China's trademark system. The seminars also addressed SAIC’s management of the system, including business tools, performance and statistical information as well as quality and customer care. Read more. IPR2 at World Expo 2010 Shanghai - Protecting IPR at trade fairs: Analysis of European and Chinese enforcement proceedings in a moot court setting, 4 September 2010 |

IPR2 will be present at this year's World Expo in Shanghai with activities dedicated to building awareness of the importance of IP protection and enforcement. Hosted in the EU-Belgian Pavilion which has thematic displays representing 'Intelligent Europe', this includes an issue of international relevance – how to protect and enforce intellectual property rights at trade fairs. In Court - Protecting IPR at trade fairs: Analysis of European and Chinese enforcement proceedings in a moot court setting: At the scene of the World Expo Shanghai 2010, in the Belgian-EU Pavilion, IPR2 will support a moot court in which Chinese and European experts simulate enforcement proceedings for the same infringement case, applying the respective legal systems for protecting intellectual property at a trade fair in Europe and China. Preparations for the case will be done at Tongji University the day before where the process of the moot trial will be introduced, roles and tasks presented and the teams and counsel put in place. For Team China, the presiding Judge is Dr Jiang Zhipei, former head of the IPR Tribunal and for Team Europe, presiding Judge Dr Klaus Grabinsky. The simulation will use role-play to engage the different players involved in a real-life and intriguing patent infringement case, and provide an opportunity to compare similarities and differences between the Chinese and European procedures and practices. EU-China training on IP European Intellectual Property Law, Shanghai, 15-17 October 2010 |

The China-EU School of Law (CESL) is hosting a training course on European Intellectual Property Law for lawyers and other legal professionals in the Madrid Pavilion at the Shanghai World Expo 2010. For a second year, the three-day training will provide an overview of European IP law, its protection and enforcement in Europe, aiming to improve the knowledge of Chinese professionals involved in legal and business transactions with Europe.
