23 June 2010, Dalian IPR2 organised a seminar to further build mutual understanding of intellectual property protection in the software and service outsourcing industry, together with the China Association of Trade in Services (CATIS), under the Ministry of Commerce (MOFCOM), in cooperation with the Copyright Protection Centre of China (CPCC) and the Dalian Copyright Protection Association. The event aimed to build understanding on the challenges and means of improving the international competitiveness of enterprises and the overall development of this industry.
The software and service outsourcing industry is knowledge-intensive, it involves state of the art technologies and it adds intellectual value to its products. Its success depends on the capacity of independent innovation of the enterprises, and on their protection and management of the related intellectual property rights. This industry has developed rapidly in China and holds a large part of trade in services; Dalian hosts an industry park from which hundreds of excellent enterprises have emerged in the international offshore outsourcing market.
The European experts detailed how software copyright is protected in Europe, outlining the laws and regulations in force and presenting in practice how European and Chinese enterprises can cooperate in software development and avoid the risk of infringing third party rights in Europe. The issue of what is protected by European courts and under what circumstances highlights the critical relation between outsourcer and developer on liabilities to third parties and to customers. It contributes to the development of China’s service industries and trade in services. CPCC operates directly under the leadership of General Administration of Press and Publication (GAPP) and the National Copyright Administration of China (NCAC), and has an important role in helping to implement the copyright law, contributing to the management of the copyright administration system and assisting copyright holders to exercise their legal rights, promoting the creation and publicity of works and realising the purpose of the copyright legislation. This follows previous co-operation between IPR2 and CATIS and CPCC in June 2009 in Dalian and Beijing with seminars aimed at enhancing the mutual understanding of intellectual property protection in the software and service outsourcing industry.
